Uncontested Divorces

Most divorces involving sizable property and/or children end up being heavily contested by both sides despite the fact the community property can often see a dramatic reduction by its conclusion. If you and your spouse are seeking an end to your marriage with as little economic impact as possible, and are emotionally committed to that end, we can draft and file your divorce petition and draft and have a judge approve your divorce decree for a minimal fee based on the issues of your specific divorce in a little over the 60-day Texas minimum divorce waiting period.

An uncontested agreed divorce will avoid:
  • Discovery: the process by which you and your spouse request documents and ask questions to ascertain the extent of the community property and the custody arrangement which is in the best interest of the children.

  • Temporary Orders: a mini-divorce decree for the period while the divorce is on file which arranges for any temporary spousal support or child support and governs temporary child custody.

  • Mediation: you and your spouse pay an impartial third-party to try and help you work out a fair settlement of any disputes concerning property or custody.

  • Trial: both parties pay lawyers for the considerable amount of time it takes to prepare evidence and attend trial.

  • Appeal: the process by which the judgment rendered in the original proceeding is contested to a higher court at a greater expense.

Attorney's Fees

John H. Carney & Associates will require an initial retainer to draft the divorce decree. Dallas charges a $130.00 filing fee provided your spouse will sign a waiver of service to avoid being formally handed a copy of the petition by a constable. If at some time you and your spouse fall into disagreement as to the terms of the divorce and you require additional work, you will be billed at our standard hourly rate for attorney's and paralegals.

Initial Client Information for the Consultation.

You should be prepared to describe the amount and value of your property and the division you and your spouse have agreed on, ie, who gets which car, who stays in the house, who gets which credit card debt, etc.

What to expect of your lawyer.

Your lawyer is your advocate and their job is to pursue your best interest at all times. Your lawyer should always try to make the process as financially and emotionally easy as possible, and this usually involves avoiding litigation when possible. A good lawyer takes the path of least resistance -- that means your lawyer should pursue the easiest way to achieve your best interest. If you and your spouse are capable of not involving the courts in deciding the terms of your divorce, and use them merely to legally dissolve your marriage, then you both can save considerable sums of money and avoid undue emotional aggravation.

Settling even when you're not worried about attorney's fees.

A settlement will only be agreed to by you and your attorney if it meets your needs. Judges and juries have a hard job of balancing the best interests of both parties and being fair and just at the same time, and sometimes they make the wrong decisions. An agreed divorce assures you that your needs are being met without leaving your divorce to chance.
